Krisis iklim menyebabkan meningkatnya minat dari negara-negara dan perusahaan-perusahaan untuk memberikan solusi berbasis hutan, seperti kerangka kerja Reducing Emissions from Deforestation and Forest Degradation <\/em>(REDD+). Bagaimanapun, ada kekhawatiran akan munculnya risiko dari investasi baru terhadap komunitas yang hidupnya bergantung pada hutan, seperti Masyarakat Adat (MA) dan komunitas lokal (KL).<\/p>\n

Kebutuhan untuk memperjelas dan memahami peran standar safeguard<\/em> REDD+ kini sudah mendesak. Safeguards<\/em> yang diterima dalam Konferensi Para Pihak pada Kerangka Kerja Konvensi PBB untuk Perubahan Iklim (UNFCCC) di Cancun pada 2010, didefinisikan sebagai berikut, \u201cprinsip-prinsip, peraturan, dan prosedur yang diterapkan untuk mencapai tujuan-tujuan sosial dan lingkungan\u201d. Hal itu telah dikonsepkan dan diartikan secara luas,mulai dari dipandang sebagai benteng pertahanan terhadap dampak terburuk REDD+ (dirujuk sebagai tujuan \u201cjangan membahayakan\u201d) hingga mekanisme untuk mempercepat peningkatan kesejahteraan dan kehidupan bagi MA dan KL dan wilayah mereka (tujuan \u201cmelakukan dengan lebih baik\u201d).<\/p>\n

Namun, karena Para Pihak UNFCCC bebas untuk \u201cmenafsirkan\u201d prinnsip-prinsip tersebut dalam kerangka hukum mereka dan kebijakan publik mereka, organisasi-organisasi yang mewakili MA dan KL serta mitra mereka mengkritik pendekatan yang dilakukan, karena gagal mengadvokasi reformasi yang mengakui dan melindungi pengakuan dan pemenuhan hak-hak MA dan KL dalam konteks di mana terdapat hambatan untuk pengakuan dan penghargaan terhadap hak-hak mereka.<\/p>\n

Karena MA dan KL mengelola wilayah yang menyimpan karbon dalam jumlah mendekati 300.000 juta ton karbon, maka hak-hak, kepentingan, dan kesejahteraan mereka tak bisa diabaikan dalam solusi iklim yang transformatif.<\/p>\n

Sebagai bagian dari Global Comparative Study tentang REDD+<\/em>, kami mengkaji dokumen-dokumen yang diterbitkan oleh 11 standar dan panduan, serta berbagai inisiatif iklim berbasis-hutan lainnya untuk menentukan seberapa besar dukungan mereka dalam menghormati, mengakui, melindungi, dan memenuhi hak-hak MA dan KL. Ini merupakan hasil awal kajian tersebut. Hasil awal kajian tersebut telah diterbitkan dalam Bahasa Inggris, Indonesia, dan Spanyol.<\/p>\n\n

Kontribusi<\/strong><\/h3>\n

Temuan kami disajikan secara ringkas dalam bentuk tabel. Dalam tabel tersebut kami membandingkan sembilan kriteria untuk memahami secara mendalam komitmen standar-standar dan panduan-panduan terkait hak-hak MA dan KL dalam menjaga hutan di mana REDD+ diterapkan.<\/p>\n

Tabel tersebut menyajikan potret sekilas tentang standar dan panduan safeguards<\/em>. Potret itu menetapkan dasar pemahaman – sekilas – akan apa tujuan safeguards<\/em>, apa yang tidak mereka lakukan, yang mana dikerjakan secara lebih keras, dan apa yang lebih mungkin dilakukan dalam arti dukungan terhadap hak-hak MA dan KL. Dalam setiap kasus, kami mengindikasikan tingkatan aplikasi (misalkan: nasional, subnasional) dan kelompok-kelompok yang secara historis kurang terwakili dalam pengaplikasian safeguards<\/em>.<\/p>\n

Berdasarkan kajian dokumen-dokumen yang diterbitkan oleh setiap standar atau lembaga, kami menetapkan perluasan yang selaras dengan setiap panduan dengan sembilan kriteria berkaitan dengan penghormatan dan pengakuan, perlindungan, dan pemenuhan hak-hak MA dan KL: (1) selaras dengan safeguards<\/em> Cancun; (2) pengakuan gender dan atau kepedulian perempuan; (3) pengakuan hak-hak MA dan ML di bawa hukum internasional; (4) pengakuan akan tanah dan sumber daya alam bagi MA dan KL;(5) pengakuan terhada hak-hak karbon; (6) pengakuan hak-hak MA dan ML untuk padiatapa (free, prior, and informed consent<\/em>); (7) persyaratan untuk mekanisme pembagian keuntungan; (8) persyaratan untuk mekanisme penyampaian keluhan secara formal; (9) ketentuan-ketentuan untuk pemantauan, pelaporan, dan verifikasi tentang kepedulian akan hak-hak dan keterlibatan sosial.<\/p>\n

Panduan safeguards<\/em> dibagi dalam berbagai tingkatan, sangat selaras dengan kriteria (ya), selaras dalam beberapa hal \u2013 untuk panduan yang hanya memenuhi beberapa aspek dari kriteria (sebagian), atau tidak sesuai (tidak).<\/p>\n

Temuan-temuan<\/strong><\/h3>\n

Kami menemukan variasi yang patut dipertimbangkan tentang bagaimana standar dan panduan safeguards <\/em>berkaitan dengan hak-hak MA dan KL. Sebagai contoh, banyak standar dan panduan yang fokus di tingkat proyek, dan amat selaras dengan safeguards Cancun. Keterlibatan gender dan\/atau perempuan ditangani dengan berbagai cara namun dengan satu standar.<\/p>\n

Hampir semua standar menerapkannya pada MA dan KL (meskipun ada perbedaan definisi di berbagai standar), namun ada dua yang tidak menyebutkan MA secara spesifik. Hanya separoh yang mengakui hak-hak MA sesuai hukum internasional, dan beberapa standar memperluas hak-hak yang diakui tersebut pada KL. Hanya empat yang secara luas mengakui hak-hak MA dan KL atas tanah dan sumber daya alam; tak ada yang mengakui hak-hak komunitas atas karbon. Hanya lima yang memiliki protokol ketat untuk padiatapa (free, prior, and informed consent<\/em>), hanya empat yang mensyaratkan perhatian pada mekanisme pembagian keuntungan, dan semuanya, kecuali satu, mensyaratkan mekanisme penyampaian keluhan secara formal.<\/p>\n

Sebagai tambahan, kami mencatat, meskipun hampir semua panduan lembaga-lembaga donor multilateral mensyaratkan pemantauan ketat, pelaporan, dan verifikasi, hanya dua dari standar sukarela yang melakukannya. Bagaimana standar-standar REDD+ yang sifatnya sukarela mendukung transformasi berbasis hak dan kembali melibatkan perempuan dan laki-laki dari MA dan KL sebagai pemegang hak-hak dan mitra, bukan hanya sebagai penerima manfaat proyek?<\/p>\n

Dengan rangkaian kajian ini, kami berharap bisa menyajikan pelajaran proponen standar guna membandingkan ketentuan-ketentuan safeguards<\/em> mereka, serta menyajikan bukti-bukti bagi para pembuat kebijakan dan para pelaku agar mempertimbangkan implikasi dan keuntungan dari langkah mendukung hak-hak MA dan KL. Seri kajian ini juga bermaksud mendorong partisipasi perwakilan MA dan KL dalam berbagai diskusi dan pemantauan safeguards<\/em>.<\/p>\n

After lecturing in Social Anthropology at the universities of Durham and St Andrews in the United Kingdom between 2011-2016, Juan Pablo is now part of CIFOR's Global Comparative Study of REDD+ (seconded from the Pontificia Universidad Catolica del Peru). Based in the Lima hub, he coordinates multi-sited research on multi-stakeholder initiatives around land use and land use change in Brazil, Ethiopia, Indonesia, and Peru. The project examines the potential role of these initiatives in transforming BAU decision-making practices in order to create more equitable outcomes for forest-dependent communities. As part of his wider work, Juan Pablo is also interested in exploring the real and potential transgressions of indigenous rights throughout REDD+ readiness and implementation phases around the world, and the potential application of this framework as a pro-rights tool that enables environmental justice for indigenous communities. Juan Pablo has carried out more than 40 months of ethnographic research with indigenous Amazonian communities since 2007, during which he has collaborated and carried out action research with indigenous organizations on their life plans, approaches to well-being, and resource management practices. After lecturing in Social Anthropology at the universities of Durham and St Andrews in the United Kingdom between 2011-2016, Juan Pablo is now part of CIFOR's Global Comparative Study of REDD+ (seconded from the Pontificia Universidad Catolica del Peru). Based in the Lima hub, he coordinates multi-sited research on multi-stakeholder initiatives around land use and land use change in Brazil, Ethiopia, Indonesia, and Peru. The project examines the potential role of these initiatives in transforming BAU decision-making practices in order to create more equitable outcomes for forest-dependent communities. As part of his wider work, Juan Pablo is also interested in exploring the real and potential transgressions of indigenous rights throughout REDD+ readiness and implementation phases around the world, and the potential application of this framework as a pro-rights tool that enables environmental justice for indigenous communities. Juan Pablo has carried out more than 40 months of ethnographic research with indigenous Amazonian communities since 2007, during which he has collaborated and carried out action research with indigenous organizations on their life plans, approaches to well-being, and resource management practices.
