{"id":50393,"date":"2017-07-07T23:29:44","date_gmt":"2017-07-07T16:29:44","guid":{"rendered":"http:\/\/www.forestsnews.org\/?p=50393"},"modified":"2019-04-23T10:39:15","modified_gmt":"2019-04-23T03:39:15","slug":"para-garantizar-derechos-sobre-la-tierra-las-comunidades-forestales-necesitan-mas-que-solo-titulos","status":"publish","type":"post","link":"https:\/\/www.forestsnews.org\/es\/50393\/para-garantizar-derechos-sobre-la-tierra-las-comunidades-forestales-necesitan-mas-que-solo-titulos","title":{"rendered":"Para garantizar derechos sobre la tierra las comunidades forestales necesitan m\u00e1s que solo t\u00edtulos"},"content":{"rendered":"<p>El <a href=\"\/\/www.cifor.org\/gcs-tenure\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Estudio Comparativo Global sobre Reformas de Tenencia<\/a> que el <a href=\"\/\/www.cifor.org\/es\" target=\"_blank\" rel=\"noopener noreferrer\">Centro para la Investigaci\u00f3n Forestal Internacional (CIFOR)<\/a> ejecuta desde el 2014 ha puesto en evidencia algunos <a href=\"http:\/\/www.forestsnews.org\/50310\/las-politicas-de-derechos-sobre-la-tierra-aun-son-insuficientes-segun-estudios?fnl=es\">desaf\u00edos comunes que las comunidades forestales enfrentan<\/a> en relaci\u00f3n con el ejercicio de derechos a la tierra y la mejora  de sus medios de vida.<\/p>\n<p>Una <a href=\"http:\/\/www.forestsnews.org\/41911\/tenencia-de-la-tierra-y-medios-de-vida-cual-es-el-vinculo?fnl=es\">conclusi\u00f3n inicial de los hallazgos en Per\u00fa y Uganda<\/a>, ambos pa\u00edses parte del estudio, indica que si bien la titulaci\u00f3n es un paso esencial y prioritario, no es por s\u00ed solo el final del camino hacia la seguridad de la tenencia y la mejora de las condiciones de vida de estas comunidades.<\/p>\n<p><strong>El caso de Per\u00fa<\/strong><\/p>\n<p>Como parte del <a href=\"\/\/www.cifor.org\/library\/6505\/reivindicacion-de-derechos-colectivos-reformas-de-tenencia-de-tierras-y-bosques-en-el-peru-1960-2016\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">estudio en Per\u00fa<\/a>, los investigadores han resaltado el caso de una comunidad nativa que se convirti\u00f3 en un ejemplo ic\u00f3nico <a href=\"http:\/\/www.forestsnews.org\/45400\/para-las-comunidades-forestales-la-titulacion-es-solo-el-comienzo?fnl=es\">de los desaf\u00edos que enfrentan las comunidades forestales m\u00e1s all\u00e1 de la titulaci\u00f3n<\/a>.<\/p>\n<p>\u2018\u2019Ante la ley peruana, un t\u00edtulo otorga a las comunidades ind\u00edgenas y nativas derechos sobre el territorio, pero recursos como los bosques se mantienen formalmente como propiedad del Estado. En este contexto, ning\u00fan individuo, comunidad o empresa puede poseer tierras forestales, sino s\u00f3lo acceder a los recursos en ellas a trav\u00e9s de un sistema contractual\u2019\u2019, explica Iliana Monterroso, investigadora posdoctoral de CIFOR.<\/p>\n<p>Adem\u00e1s es ampliamente conocido que en tierras p\u00fablicas, el Gobierno otorga concesiones a particulares o empresas por un tiempo determinado. Estas concesiones pueden brindarse para actividades extractivas, como madera o miner\u00eda, reforestaci\u00f3n, conservaci\u00f3n, ecoturismo u otros.<\/p>\n<p>\u2018\u2019En otras palabras, los derechos de propiedad pueden ser otorgados s\u00f3lo para las tierras agr\u00edcolas, mientras que el Estado conserva la propiedad de los recursos del subsuelo, como los minerales, y de los bosques sobre el suelo\u2019\u2019, explica Monterroso.<\/p>\n<p>Como consecuencia, mientras que a las comunidades tradicionales se les conceden derechos de uso a largo plazo sobre los bosques, empresas e individuos tambi\u00e9n obtienen derechos de uso, muchas veces dentro del mismo territorio, conllevando a situaciones de superposici\u00f3n de derechos sobre diferentes recursos en las mismas tierras, lo que muchas veces resulta en conflictos sociales.<\/p>\n\n<p><strong>La lucha de Tres Islas<\/strong><\/p>\n<p>Este fue el caso de la comunidad ind\u00edgena de Tres Islas, en la regi\u00f3n amaz\u00f3nica de Madre de Dios. En 2010, los l\u00edderes de la comunidad decidieron construir una valla para detener a mineros y madereros ilegales que estaban accediendo sin permiso el territorio comunal. A los mineros se les hab\u00edan concedido derechos sobre las tierras comunales sin que la comunidad lo autorice.<\/p>\n<p>Los l\u00edderes de la comunidad, que hab\u00eda sido reconocida y titulada, pensaron que estaban ejerciendo uso de su derecho al limitar el acceso de los mineros,  sin embargo, fueron demandados y encarcelados por impedir el paso de los for\u00e1neos.  Posteriormente, la comunidad llev\u00f3 su caso al Tribunal Constitucional del Per\u00fa y gan\u00f3 el juicio, estableciendo un precedente legal que asegura la protecci\u00f3n de la autonom\u00eda territorial ind\u00edgena y exige un mecanismo de consulta en cualquier caso que afecte directamente el territorio de las comunidades reconocidas.<\/p>\n<p>\u201cEl caso de Tres Islas muestra <a href=\"http:\/\/www.forestsnews.org\/50310\/las-politicas-de-derechos-sobre-la-tierra-aun-son-insuficientes-segun-estudios?fnl=es\">los desaf\u00edos que a\u00fan quedan para muchas comunidades forestales<\/a> de todo el mundo, donde solo el t\u00edtulo o el reconocimiento de derechos mediante certificaci\u00f3n o permisos no garantizan la seguridad de la tenencia ni mejores medios de vida, objetivos centrales de estos procesos de reforma\u201d, resalta Monterroso.<\/p>\n<p>Adem\u00e1s, <a href=\"\/\/www.cifor.org\/library\/6505\/reivindicacion-de-derechos-colectivos-reformas-de-tenencia-de-tierras-y-bosques-en-el-peru-1960-2016\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">un an\u00e1lisis hist\u00f3rico que forma parte del estudio<\/a> ha mostrado que mientras los gobiernos contin\u00faan discutiendo las reformas para simplificar las regulaciones, las organizaciones sin fines de lucro han sido instrumentales para asegurar que las comunidades reciban apoyo t\u00e9cnico, para cumplir con las normas y estar en una posici\u00f3n mucho mejor para beneficiarse de los recursos disponibles en sus bosques.<\/p>\n<p>Sin embargo, las recomendaciones sugieren que se necesita un apoyo continuo para asegurar que las comunidades puedan desarrollar las habilidades necesarias para aprovechar los derechos adquiridos, como usted puede ver en <a href=\"https:\/\/www.youtube.com\/watch?v=08DkBABfOz8\" target=\"_blank\" rel=\"noopener noreferrer\">este video<\/a> desarrollado como parte de esta investigaci\u00f3n.<\/p>\n\n<p><strong>Esta investigaci\u00f3n fue llevada a cabo por CIFOR con el apoyo de la Comisi\u00f3n Europea, el Fondo para el Medio Ambiente Mundial (GEF), el Fondo Internacional de Desarrollo Agr\u00edcola (FIDA) y la Organizaci\u00f3n de las Naciones Unidas para la Alimentaci\u00f3n y la Agricultura (FAO).<\/strong><\/p>\n<hr \/>\n<p style=\"text-align: center;\"><span style=\"color: #999999;\">El video sobre Tres Islas fue producido por Yoly Guti\u00e9rrez y Mart\u00edn Balbuena.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>El Estudio Comparativo Global sobre Reformas de Tenencia que el Centro para la Investigaci\u00f3n Forestal Internacional (CIFOR) ejecuta desde el 2014 ha puesto en evidencia algunos desaf\u00edos comunes que las comunidades forestales enfrentan en relaci\u00f3n con el ejercicio de derechos a la tierra y la mejora de sus medios de vida.
